Purchasing and Delivery of Wine and/or Spirits
Your acceptance of these Terms of Service will be acknowledged by your placing an order on wildvineny.com, Wild Vine & Liquors. By accepting these Terms of Service, you (also referred to herein as “Buyer”) are accepting them for the duration of your buying relationship with Wild Vine & Liquors (also referred to herein as “Seller”, “we” and “us”)These Terms of Service will also apply to any retail purchases you make with us over the phone or through email should you choose to. We will notify you of changes to our Terms of Service as they may occur in the future. We appreciate your business and thank you for taking time to read and understand this document.
By placing an order for wine and/or spirits, Buyer warrants that they are at least 21 years of age, and that the recipient of any delivery of the wine and/or spirits will be at least 21 years of age.
Except for orders described in the next paragraph, title to and ownership of wine and/or spirits passes from Wild Vine & Liquors (Seller) to Buyer in New York, and Buyer takes all responsibility for the product being transported from the state of sale to the buyer’s selected destination. Buyer may pick up the product at Seller’s location or make independent delivery arrangements. Sales tax will be applied based on the Seller’s location. Seller makes no representation as to the legal rights of anyone to deliver or import any alcoholic beverages or other goods into any state. Buyer warrants he or she is solely responsible for the transport of the purchased products and for determining the legality and the tax/duty consequences of bringing the products to the buyer’s chosen destination. All taxes, duties, and/or tariffs imposed at the time of delivery are the sole responsibility of Buyer and must be remitted prior to the release of the wines and/or spirits.
We urge you to investigate the laws in your state or country regarding this subject before shipping or arranging to ship any wine and/or spirits purchased from us.
Buyer will be assessed a 25% return/restocking fee should any order be returned to Wild Vine & Liquors due to but not limited to the following: no person at least 21 years of age at the address; the address provided is not valid; the shipment is refused by the recipient.
If Wild Vine & Liquors, for any reason, is unable to fulfill its obligations to Buyer, Wild Vine & Liquors' sole obligation and Buyer's sole recourse shall be a refund of the purchase price.
Wild Vine & Liquors makes no warranty, expressed or implied, about the wine and/or spirits being sold except that Wild Vine & Liquors is conveying clear title to the purchased product and, to Wild Vine & Liquors' knowledge, the wine and/or spirits is what its label describes it to be. Specifically, because wine and/or spirits by its nature is subject to change in the bottle over time, Wild Vine & Liquors makes no warranty or guarantee of the quality or drinkability of any wine and/or spirits sold.
THE WARRANTIES SPECIFIED IN THIS CONTRACT ARE IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
This contract is entered into in New York and shall be enforceable there under the laws of that State.
Wild Vine & Liquors' prices are good while supplies last. Discount and/or promotions cannot be applied to previous purchases, futures or gift orders. Wild Vine & Liquors reserves the right to correct errors on pricing and to limit quantities ordered.
All orders are subject to confirmation by Wild Vine & Liquors. Order processing time is contingent upon payment authorization and does not include weekends or holidays. Please allow up to 48 hours for our delivery team to coordinate your order upon completion of payment.
By submitting your order for confirmation, you hereby represent to Wild Vine & Liquors that you understand these Terms of Service and agree to abide by them in connection with this transaction. The placing and accepting of an order shall form a contract on these terms, conditional upon confirmation of the order by Wild Vine & Liquors, which may be evidenced by the delivery of an invoice.
Payment is due upon order confirmation. By providing your credit card number, you authorize Wild Vine & Liquors to charge your credit card for the costs associated with your wine and/or spirits purchase as described in these Terms and Conditions (for example, for purchase price, tax, redelivery, other fees/charges). The Wild Vine & Liquors charge will appear on your statement immediately following placement of your order. By authorizing Wild Vine & Liquors to charge your credit card, you acknowledge and agree to be financially responsible for any and all charges incurred in connection with your transaction. You hereby warrant and represent that you have the authority to legally bind the cardholder as set forth herein
Prompt Pickup or Delivery Instructions Required
Once you receive confirmation of your order from the Seller (and an invoice) you have ninety (90) business days in which to either pick up or arrange for delivery of the order. All orders that (a) have been confirmed, (b) are in stock, (c) have not been held for a later ship date (per Seller’s sole discretion), and (d) have either not been picked up or no instructions for their delivery have been given to Seller by Buyer within ninety business days will be automatically canceled and returned.
